    Novo Nordisk (NYSE:NVO) CEO Mike Doustdar is defending the drugmaker’s lawsuit against Eli Lilly (NYSE:LLY), escalating a fight over how the two companies market their blockbuster obesity treatments. The legal battle matters because Lilly has seized the lead in the U.S. obesity-drug market, raising the stakes for Novo as it tries to narrow the efficacy gap consumers may perceive between Wegovy and Zepbound

    Novo Nordisk develops treatments for diabetes, obesity and other chronic diseases, with Wegovy and Ozempic among its most important products. Eli Lilly’s rival GLP-1 portfolio includes Zepbound for obesity and Mounjaro for diabetes

    Competition has to be fair, Doustdar said while defending Novo’s lawsuit

    The dispute centers on advertisements citing a head-to-head trial in which patients receiving the maximum tolerated 10 mg or 15 mg dose of Zepbound lost an average 20.2% of their body weight over 72 weeks, compared with 13.7% for Wegovy

    Novo argues that comparison no longer presents the full competitive picture because it used an older Wegovy dose. The FDA approved Novo’s higher 7.2 mg Wegovy dose on March 19, 2026. Novo says a separate study of the higher dose produced average weight loss of 19% over 72 weeks

    The commercial stakes are substantial. Lilly’s U.S. Zepbound revenue jumped 44% year over year to $4.9 billion in the second quarter, showing how rapidly the franchise continues to scale

    For investors, the lawsuit is ultimately about competitive positioning rather than legal damages alone

    If Novo succeeds in forcing changes to Lilly’s advertising, it could weaken one of Zepbound’s most powerful marketing advantages: the perception of materially superior weight loss. But the bigger battle will still be decided by real-world adoption, pricing, supply and next-generation drugs

    Novo’s September 21 Capital Markets Day is the next major opportunity for management to detail its obesity strategy, followed by third-quarter results on November 4. Investors should watch uptake of high-dose Wegovy, U.S. market share and Lilly’s Zepbound growth closely. Unless Novo can translate improved efficacy into prescriptions, changing the advertising narrative alone may not materially alter Lilly’s lead
