    A family is suing an El Segundo gym after they say their toddler was thrown in the air and fell to the ground at the facility’s daycare. Alex Rozier reports for the NBC4 News at 5 p.m. on Wednesday, July 8, 2026.

    A family is suing a fitness club in El Segundo after they said their child was seriously injured when he was tossed in the air and dropped on the floor at the gym’s daycare

    The 23-month-old child was dropped by a daycare worker last March at the Bay Club, according to the lawsuit

    In the lawsuit, the father said he brought his child to the daycare and left for the Manhattan Beach Country Club. When he returned, the child was seriously injured, according to the lawsuit

    The incident was recorded on video, which appeared to show a daycare worker at the Bay Club Clubhouse swing the child by the arms into the air. The child then appeared to strike his head on the hardwood floor before the worker landed on top of him

    The child’s parents are suing the Bay Club for negligence, claiming the child suffered “a traumatic brain injury” when he hit the floor after he was tossed “approximately 6 feet above the ground.”

    The lawsuit claims the Bay Club lied to the parents about the severity of the injury and how the incident occurred. According to the lawsuit, the club initially gave the father the impression that his son only sustained a minor injury

    “The deception by the Bay Club of hiding this horrific incident from the parents is inexcusable,” the family said. “The daycare facility should have the highest amount of care for the children, and if a child gets sick or injured, they should notify the parents with transparency and urgency.”

    The Bay Club, which operates more than 25 clubs primarily in California, responded to the lawsuit

    “We are unable to comment on ongoing litigation,” the Bay Club said. “At the Bay Club, the safety of our members, team members, and the families we serve is our highest priority.”

    The Department of Social Services said in California there are child care regulations intended to promote children’s health and safety in licensed child care facilities, but some facilities are exempt from licensing, including businesses that offer limited child care to their clients and customers — usually while a parent remains on site

    The Bay Club Clubhouse did not confirm whether they are a licensed childcare facility

    The family, attorneys for the family, and representatives for Bay Club did not make themselves available for an on camera interview Wednesday. The family did not say how much money they are seeking, but they are demanding a jury trial
