Danish pharmaceutical company Novo Nordisk (NVO, Financials), a maker of diabetes and obesity therapies, wants a U.S. court to issue a preliminary injunction to halt rival Eli Lilly’s advertising.Novo accused Lilly of violating false advertising and unfair competition rules with its Zepbound and Mounjaro campaigns for obesity and diabetes treatment respectively.Lilly said Novo compared the highest approved doses of its medicines to lesser doses of Wegovy and Ozempic, while leaving out newer, higher-dose versions of Novo’s products.Novo said the comparisons give a false impression that Lilly’s drugs work better. It is seeking a preliminary injunction and a permanent ruling compelling Lilly to pull the ads and engage in corrective marketing.Lilly has denied any wrongdoing, saying it stands by its advertising and will to defend itself against the complaint.The lawsuit is the latest in a battle between the two corporations to dominate the obesity medicine industry, which analysts say may be worth more than $100 billion a year in U.S. sales by the end of the decade.Now investors will be watching to see whether the court curbs Lilly’s promotion and what impact the issue has on marketing tactics across the weight-loss medicine business.
