An Allentown man has been charged with indecent assault at Palmer Township gym
Stephen McCarthy, 35, of the first block of Seventh Street, also is charged with two counts misdemeanor simple assault; one count summary harassment; and one count summary disorderly conduct
McCarthy was arraigned Friday before District Judge Jordan A. Knisley, who set bail at 10% of $100,000. In lieu of bail, he was sent to Northampton County Prison, where he remained Monday
The Northampton County Public Defender’s Office, assigned to McCarthy, didn’t immediately return a request for comment Monday afternoon
Township police just after 7:30 p.m. Friday were called to Supersets Gym, 2417 Nazareth Road, for a reported man masturbating inside a bathroom stall
While officers were en route, an additional call came in reporting that McCarthy was allegedly fighting with people in the locker room
Two men told police they witnessed McCarthy exposing himself in the stall and moaning, according to the affidavit of probable cause against McCarthy
When McCarthy left the stall, he tried to push through the men and began swinging at them with closed fists until they wrestled him to the ground and called police, court records state
McCarthy has a prior criminal history
Court records show he was placed on federal probation following charges in a separate past case
Supersets Gym owner Ed Frack couldn’t immediately be reached for comment Monday afternoon
McCarthy is due back in court for a preliminary hearing tentatively scheduled for 1 p.m. Aug. 8 before District Judge Susan Hutnik. A judge will then determine if there’s sufficient evidence to send the case to trial at the Northampton County Court of Common Pleas
