Illinois’ new Companion Animal Custody Equity Act takes effect Jan. 1, 2027, expanding how courts may resolve pet custody disputes

An Illinois law set to take effect next year will give courts new authority to consider the well-being of pets when resolving custody disputes between separating couples. The legislation follows the story of a senior dog named Rosie, whose custody dispute led advocates to push for changes they said addressed a gap in state law
Beginning Jan. 1, 2027, the Companion Animal Custody Equity Act, also known as HB 4540, will take effect in Illinois. Under the law, courts may consider factors such as a companion animal’s caregiving history, emotional bonds and living environment when deciding possession disputes, regardless of whether the parties were married

The legislation comes after the launch of the Rosie’s Law Initiative, which was created following a custody dispute involving a senior Puggle named Rosie
Rosie spent years with her primary caregiver, accompanying them throughout the workday and becoming part of their daily routine, according to the initiative’s website
“For more than half of her life, I shared the daily care at the center of our bond: meals, walks, veterinary appointments, insurance, medication, comfort, and the quiet repetition through which an animal learns where home is,” Rosie’s caregiver wrote on the website
The caregiver said that after the end of a long engagement, Rosie initially remained in their care before she was removed in March 2025

“My requests for her return, mediation, visitation, and continued contact did not reunite us,” the caregiver wrote
The website said the experience led to the creation of the Rosie’s Law Initiative, which sought changes to Illinois law governing companion animal disputes
The effort began in December 2025 with draft legislative language built around what it described as a central question: “How should courts evaluate companion-animal disputes when caregiving, continuity, and welfare matter deeply to an animal’s life?” according to the Rosie’s Law website
The initiative said its work was based on the belief that “companion animals deserve legal consideration that reflects the relationships, routines, and lives they actually have.”

Under the new law, judges may consider evidence including each person’s history of caring for the animal, involvement in feeding, grooming, veterinary care and training, financial contributions, emotional bonds with the pet, the stability of the animal’s living environment and continuity of care
The legislation also authorizes courts to issue temporary possession or caregiving orders, including limited visitation, while a dispute is pending if doing so would reduce stress or disruption for the companion animal
The act further allows judges to order mediation between parties when appropriate

In the law’s findings, the Illinois General Assembly said companion animals “often occupy a unique role within households that is not fully reflected in existing statutory frameworks governing possession disputes.”
Lawmakers also noted that although Illinois courts already had authority to consider an animal’s well-being during divorce proceedings, disputes involving unmarried couples lacked explicit statutory guidance
The Rosie’s Law website said the initiative was never intended to center on the people involved in the dispute, but on the dog whose story prompted the effort
“This story can be told without turning anyone into a public character,” the website said. “Its focus is Rosie: the life she lived, the relationships she formed, the care she depended upon, and the legal system that had no meaningful way to consider her well-being.”
