A federal judge will decide Thursday whether social media influencers Andrew and Tristan Tate can walk out of a Miami detention center while they fight extradition to Britain on rape and sex trafficking charges
The brothers have been held in federal custody since their July 18 arrests and brief initial court appearance. Both have denied wrongdoing
U.S. Magistrate Judge Lauren Louis is expected to hear arguments from prosecutors and defense attorneys before deciding whether the Tates should remain behind bars during an extradition battle that could stretch for months
Their attorneys argue that the brothers are so famous — and maintain such a visible presence online — that disappearing would be virtually impossible
Prosecutors see it differently
They say international extradition cases carry a strong presumption against release and argue that the brothers’ boasts about multiple passports, enormous wealth and connections around the world make them serious flight risks
The defense has responded by arguing that much of the extravagant lifestyle the Tates promoted online was exactly that — promotion
Their lawyers say claims about possessing multiple passports were satirical, a supposed $50 million superyacht featured in a video was not theirs and luxury cars showcased online, including a $2.1 million Aston Martin, were rented
The defense also points to the brothers’ conduct in Romania, where they face separate allegations that they lured women for sexual exploitation. The Tates deny wrongdoing in that case, and their attorneys say their compliance with restrictions there demonstrates they can be trusted not to flee
No date has been set for their extradition hearing. Britain has until mid-September to provide supporting evidence to the U.S. State Department
The latest case adds another chapter to an international legal saga involving the brothers in Britain, Romania and the United States
Andrew Tate, 39, and Tristan Tate, 38, are dual U.S.-U.K. citizens who built enormous online followings around content promoting wealth and male dominance. Critics have repeatedly condemned statements by the brothers about women as misogynistic. The Tates have maintained that many controversial comments were jokes or taken out of context
Both are also outspoken supporters of President Donald Trump, although the White House has said they should not expect the president to intervene on their behalf
Andrew Tate, a former professional kickboxer, first gained widespread attention after appearing on the British reality show “Big Brother” in 2016. He has since amassed more than 10 million followers on X while being banned from several other major platforms for violating their policies
Tristan Tate has worked with his brother on several business ventures
Thursday’s hearing will not determine whether the brothers are extradited. Instead, the immediate question before the judge is whether they remain in federal custody while that fight plays out
